PROPOSED EXECUTIVE ORDER ON MEANINGFUL AND EQUAL ACCESS TO CIVIL JUSTICE, ON THE CREATION OF HUMAN RIGHTS AND DUTIES "LIGHT-HOUSES" CENTERS AND ON THE STRENGTHENING OF WASHINGTON STATE'S JUSTICE SYSTEM

 

WWHEREAS, Justice systems are founded upon the fundamental principle that the Courts must be equally accessible to all persons, whatever the race, sex or finance, that the principle "equal access to the courts" entails the "equality of arms" principle,

 

WHEREAS the facts show that Civil Justice is not accessible to those who can not afford it,

WHEREAS the facts show that Washington's legal system is under-invested,

NOW, THEREFORE, I, ..................................... Governor recommit to making Washington State a leader in the the Justice field, In this perspective, it is ordered that the following measures will be put in place within the first year of my Governorship.

NOW, TH1. An emergency task force to examine Washingtonians legal system and make recommendations,

2. A civil  legal aid  law  for all the needy. Annually, seventy to eighty percent of the civil legal needs of the modest income go unmet. Many mid-income familes also prefer to refrain from vindicating their rights because of the expenses of the Justice system. For the pro ses that decide to take on their cases themselves, the system is often too oppressive. Too many professional are too eager to repeat that these pro ses parties "have a fool for a client". To pay heed to our Two Constitutions, it is necessary for all to be able to benefit from the constitutional right called "equal access to justice " In clear, this means that all those who can not afford an attorney must be granted public expenses to hire one, as is done in Europe.


3. Legislation to promote civic and human rights light-centers to be established first in each county and then, two years later, in each town and enlivened with art, music, education on human rights and duties and equal access to justice workshops,
 
4. Increased appropriation of public expense to increase the number of judges, bailiffs, courtrooms, healthy organic food cafeterias (with plant based diet options), meditation centers, pro se legal libraries and pro se training workshops and ethics committee with new accountability rules on the judgment committee composition for both judges and attorneys ethics hearings: 50 percent attorney and-or judges with 50 percent citizens (as opposed to attorneys and-or judges reviewing ethical behavior of fellow attorneys and-or judges),

5. Legislative reform to better assist the  People’s needs and health and promotion of pro se leniency rules and a direct and prompt pro se oral access to the Courts for rapid resolution of the case, as was done in the ancient Greek system and obligation for judges to motivate (give reasons) all of their orders,

6.  Legislation in favor of more pro bono and the unbundling attorney services and legislation for all judges and attorneys to take internationally recognized human rights law courses, civic education and personal and fundamental freedoms seminars and holistic health,

7. The drafting of a “ public funding of all electoral positions” bill. The prohibition for judges to hear a case whose party has financed that judge's electoral campaign.

8. A plan to reduce Congress’ delegation of legislative responsibilities to independent commissions and agencies and the reinvigorate the governmental balance of power doctrine.

 

These efforts shall be coordinated by the Attorney General Office, the Secretary of the Department of Social and Health Services, the Secretary of the Department of Health, and the Administrator of the Health Care Authority in partnership with the Governor's Office.

So it be ordered on behalf of the People of Washington State and the Common Good.

This Executive Order shall take effect immediately.
